The Produce Safety Standard defines agricultural water as water used in the activities covered by the standard on covered fresh produce where the water is intended for, or likely to come into contact with, the produce or food contact surfaces. Covered fresh produce are products subject to the requirements of the standard. The term " covered fresh produce" refers to the harvestable or harvested portion of the crop. Agricultural water may be used in cultivation or production activities, including irrigation water applied by direct application methods, water used to prepare sprays to be given to the produce, water for frost protection, water to cool the produce, and water used in mixtures that are applied directly to the produce before harvest. Agricultural water may also be used during and after harvest. This may include water used in the field, during harvesting, packing, or storage activities. This water includes water used to wash or cool harvested fresh produce and water used to prevent dehydration. Other uses of water in post-harvest include ice making and water used for mixing and applying wax. and fungicides for handwashing and cleaning and disinfection activities. If any orchard uses water that does not meet the definition of agricultural water, this water is not subject to compliance with the requirements of the Agricultural Water Standard. For example, water that does not come into contact with fresh produce is not considered agricultural water, as is the case with water used for drip or furrow irrigation in an avocado orchard. However, that same water, regardless of its use, would be considered agricultural water if it is used to prepare a mixture of agrochemicals that is applied directly to avocados. The FTC is considering ways to simplify the requirements of the Agricultural Water Standard and in September 2017 proposed extending the compliance dates for the Agricultural Water Standard requirements for produce subject to the Standard, with the exception of sprouts.
