The Foreign Supplier Verification Program (FSVP) is a regulation that applies to food importers in the U.S., requiring them to conduct certain risk-based activities to verify that imported food was produced in a manner that meets U.S. food safety standards. This regulation does not apply to food exporters located in other countries. The FSVP is a VIP program that importers subject to the regulation must have in place to verify that their foreign suppliers are producing food in a manner that provides the same level of public health protection as the Preventive Controls and Fresh Produce Standards, as applicable to the type of food, and to ensure that the supplier's food is not adulterated and is not mislabeled with respect to allergen labeling. The term "importer" is defined in the regulation. The FSVP importer must be located in the U.S. and must be a person who lives in the U.S. or has a physical address in the U.S. A mailing address is not sufficient. Answering machine service or reporting any location in the United States where the importer is not physically present. The foreign supplier of a food is the establishment that manufactures or processes the food, raises the animal, or grows the food that is exported to the U.S. without further manufacture or processing by another establishment, except for subsequent processing that consists solely of labeling or some similar activity of a minimal nature. For example, if you import packaged dog food from a foreign distributor who obtains it from the manufacturer in its final packaging, the foreign supplier would be the dog food manufacturer. Or, if you obtain mangoes from a packing plant that only packs and stores the fruit and does not process the mangoes beyond something of a minimal nature, the foreign supplier would be the orchards that grew the mangoes. There are exemptions to the Foreign Supplier Verification Program regulation, and these are based on the type of food (foods not subject to this rule), country of origin ( countries with official recognition or a food safety system equivalent to that of the U.S.), size of the importer or supplier, among other factors. The FTC and the development of a flowchart help determine whether or not a company is subject to the program. According to the Foreign Supplier Verification Programs standard, if the standard applies, the importer must establish a Foreign Supplier Verification Program for each food item imported from each of its foreign suppliers. The importer may request information from its foreign supplier or other members of the supply chain to comply with the requirements of the Foreign Supplier Verification Program.
