Understanding Legal Protections and Potential Liabilities Associated with Seed Use in Pennsylvania.

As we approach a new growing season, it’s a good idea for all of us to be familiar with seed laws as they relate to replanting or selling seed. A recent blog post in the Penn State Agricultural Law Blog by Ross Pifer and M. Sean High was a good review for me. It details some of the differences in the seed protected by the Plant Variety Protection Act (PVPA) and also seeds protected by patents. The blog also discusses the requirements to sell seed in our state. Understanding these issues can help avoid legal costs and penalties associated with improper seed purchasing decisions.
