SHOP Update - October 7, 2015
President Obama recently signed a bill into law that permits states to continue to have the option to treat employers with 51-100 employees as "large employers" for purposes of health insurance markets OR to treat these employers as "small employers." This new law does not, however, change the employer responsibility requirements to offer coverage.
Employers with more than 50 full time and full time equivalent (FTE) employees will have to offer their full-time workers health insurance coverage that meets minimum value and affordability requirements or face potential penalties.
The SHOP Marketplace continues to be available only to those employers with 50 or fewer (FTE) employees.
Employers are encourage to consult the the SHOP Marketplace for updates regarding the impact of this recent legislation on their specific circumstances.
